rude neighbor
i have a question for everyone here, i have this neighbor before i moved in she always came to my work (walgreens) bought what she needed any visited ask about my baby. i told her one day that were going to move in to the place that was next to her. she was saying that if we needed a co-signer shed do it and if we needed someone to baby sit she would do it. now we have been at this place since the middle of april. i havent seen her once at walgreens and she was one of our locals. to day she complained that we were bb-qing (the fire was going out of control and was going to burn up her yard) another incident, when we first moved in we had some ppl help us move in they parked on her side(she is also a renter and she doesnt have a vehicle just a hand kart). another incident, my baby is 4 months old. he has colic and we had to decrease his feedings because hes getting too much breast milk, somenights he gets in these bad moods and he screams, our neighbor bangs on the wall telling us to knock it off. because of that we had to get a dr.'s note telling her why the baby cries. theres a few other things umm cant wash my car cuses me out about that. cant weed wip the back yard once again cusses us out then her dog out.the good thing is thew property mang. is on our side. me and my wife are getting frustrated we dont have the money to move. what do you guys recommend? thanks

well one time
OK, prior service U.S. army here... Had a neighbor couseng issues so i took a 30OT6 and blew a hole in the cover of her septic tank. Second story window of my house gave me a perfect angle. than i called the city and filed a complaint. She had it fixed 2 days later so i blew the new cover. took about 6 rounds of this before the city finally had enufgh, they gave her a date to have it fixed by or she would have charges filed. Morning the inspector was coming out i blew it again. She told the city it must be a strange localized earthquake couse she swears she has no idea. to avoid having charges pressed, she just moved.

I have a neighbor like that.. she has called the police on me and my sister lots of times.. like when the pizza delivery guy parks in her driveway (which happens to be soo close to our house.. that no one thinks aobut it at all.. and i keep on telling her that its our driveway.. since we at least have 4 f from the side of the house.. shes a pain in the ass.. what i would do... get some random drug dealer.. from some place.. to tape some cocaine under the damn yellow cart.. and then call the police... and voila... shell be gone for a good while... and i would actually talk to the police.. cause after soo many times of the police having to come to the house for public disturbance.. they can ask her to move.

She has a right to complain. This is America. And you have a right to complain as well. If you esculate by doing stuff that some are suggesting in here you could find your self in jail. Your wife and baby need you to stay honest and fight her with the laws that protect your rights.
If you have lost any time from work. Like for instance when you went to your baby doctors to get a note explaining why your baby woke her up.
Thats a money loss dude. It's called damages. You can sue her in small claims court for it and any other "damages" you have incurred.
In California it will cost you $25 dollars to file a claim on her. If she doesn't show up in court you win. You can sue for up to $5,000.00 in damages. You don't have to have $5k in losses to get it, just a judge that understands the problem. You need to have a good statement for that judge. You need receipts. If you lose your out the $25.00. I think if you take her to court she will be a better neighbor. And will think twice the next time she complains to you.

when we got the letter from the doctor i was actually at work my wife had to get the letter and she is a stay at home mom. so no lost wadges (yet). but our property mang. says that she sent a letter to the owner telling him what she has done to us. and she sent a letter after she heard from the owner she gave her a last warning that if she does this again she will be evicted. and from what i heards she has done this before. everytime she came to my work she was always complaning about her neighbor. this is one of those times where you need to hear both sides. so i guess she has done this to quite a few people. in the back of my mind i would put a snake in her mailbox, out coke in her house, blow the cover off the septic tank (that one would be pretty funny though) but its just suping to her level though. we are just going to try to see if shell move first or when i pass my test well move out.

Well, there are other "damages" you can use to win a small claim on her. You do not need a receipt for any "mental anguish" or "stress" that caused you and/or your wife to go to a doctor and get that "why the baby is crying at night excuse".zerosilence wrote:when we got the letter from the doctor i was actually at work my wife had to get the letter and she is a stay at home mom. so no lost wadges (yet). but our property mang. says that she sent a letter to the owner telling him what she has done to us. and she sent a letter after she heard from the owner she gave her a last warning that if she does this again she will be evicted. and from what i heards she has done this before. everytime she came to my work she was always complaning about her neighbor. this is one of those times where you need to hear both sides. so i guess she has done this to quite a few people. in the back of my mind i would put a snake in her mailbox, out coke in her house, blow the cover off the septic tank (that one would be pretty funny though) but its just suping to her level though. we are just going to try to see if shell move first or when i pass my test well move out.
Or for that matter, any anguish or stress you and your family are occurring right now.
Also, baby's do cry when the parents are under stress dude !
You could file a claim for up to $5,000.00 (usd) on her. If she has had other complaints? Thats all the better your case is. You don't need a lawyer. Just $25.00 and facts.
If i were you ? I would at lest go down to your local court and ask to talk to a "representative from the district attorney office".
That person will sit down with you and listen to your problem. He/she will advise you how to file a "small-claims-court" claim.
He/she will probably help you fill out the form.
Like I said, you have everything to gain and if you do lose ?
It's only $25.00 out of your pocket.
good luck !
