yes the resinator should be taken out if you want more power. its free so the best mod for a woo. its restrictive so your engine doesn't get that much air. take it out to free it up and you'll feel a noticable difference.
pros:
~more power
~better fuel economy (if you lay off the throttle)
cons:
~louder
~worse fuel economy if you stay on the throttle
the louder thing can be a pro or a con... depends on your perception i guess. it makes a little sucking noise and a "psht" sound, but it's not nearly as loud as an aftermarket exhaust.
it's not illegal and not damaging anyway. if anything, it will help the car out
no its not illegal. it will get a little louder in the engine bay but not too bad. the resistor is just to make it quieter. your gas mileage will stay about the same if not better.

for me it is a big con... my car sounds much better now and last night i was racing with Zikas (1.6 16v Nubira) and he also removed the resonator and got a K&N OEM replacment fiter... his car sounded amazing  (he smoked me BTW but i caught him by doing a crazy late braking manuver... i love my new tires  )
